Terms & Conditions of Trading
REMITTANCES:
Cheques and Postal Orders to be made payable to P. & R Howard (Music) Ltd.
TERMS:
5 may be deducted from invoices if payment is received within 7 days of invoice date.
VAT & CARRIAGE ARE STRICTLY NETT.
INTEREST ON OVERDUE ACCOUNTS
We reserve the right to charge a commercial rate of interest on any overdue account.
TITLE OWNERSHIP
a) The goods supplied hereunder shall remain the absolute property of the supplier and shall be held by the Buyer in all respects as a bailee until payment in full of any amounts invoiced or due to the Supplier by the Buyer in any respect.
b) Without prejudice to the generality of the previous sub-clauses the goods supplied hereunder shall remain the absolute property of the Supplier and shall be held by the Buyer in all respects as a bailee until payment in full of all amounts invoiced or due to the Supplier by the Buyer in respect thereof or until the goods are re-sold by the Buyer whichever shall first occur and in the event of re-sale of the goods the proceeds of any re- sale shall be held for the account of the Supplier for the discharge of all monies owing by the Buyer to the Supplier in respect of the goods supplied hereunder.
c) As bailee the Buyer shall keep the goods safety stored and shall properly insure the Supplier's goods at their full reinstatement value.
d) During any period between delivery to the Buyer and the passing of the property in the good the risk of the goods shall be the Buyer's.
e) If a Buyer shall enter into liquidation or have a winding-up order made against it or have a receiver over its assets, income or any part thereof before the property in the goods has passed in accordance with the Condition the Supplier shall be entitled immediately after giving notice of its intentions to repossess to enter upon the premises of the Buyer with such transport as may be necessary and to repossess any goods to which it has title hereunder.
f) No Liquidator or Receiver of the Buyer shall have authority to sell goods to which the Supplier has title without the prior written consent of the Supplier.
CARRIAGE
All goods to a trade value of £250.00 and over are sent carriage paid.
CLAIMS
All merchandise is most carefully inspected and tested prior to despatch, but should goods be damaged or short upon receipt the Buyer should inform the Supplier immediately.
